OFFICER'S
Good Afternoon Chief’s,
I would like to ask your assistance
regarding a matter that has generated
multiple complaints into my office.
Reportedly, there have been numerous
individuals identifying themselves as police
officers that have attempted to “tin” their
way into the prepaid parking areas at the RU
Football games. There have been several
different reports that some of these
officers displayed their shield and directed
threatening behavior and statements at the
contract civilian parking employees who had
denied them access to the prepaid parking
area as per their instructions. None of
these officers were specifically identified.
I have advised the supervisor of this group
to have their parking staff record the
information on the badge, license plate and
vehicle information as warranted and to
contact an RUPD police supervisor to address
any threatening behavior or statements by
any individual including those identifying
themselves as officers. My supervisors have
been instructed to take appropriate action.
A game day parking area has been established
for police and police tailgates in
Johnson Park near the intersection of River Road and
Hillcrest for all RU Football games. A
shuttle on a continuous loop drops off at
the stadium south gate. Route 18 and 287
intersect with River Road.
Please pass this information on to your
FOP/PBA representatives and notify the
officers under your command that this
parking area has been established for their
use.

has passed away.
John was an Army Veteran and a
retired New York City Fire Fighter. His wake will be held on
Wednesday & Thursday from 14-1600hrs & 19-2100hrs at the Day Funeral

1100hrs on Friday at St. John's United Methodist Church, Hazlet.

following were introduced as changes to our Local's By-Laws. They
will be considered at the next Union meeting. The first section
below is a new change and involves our dues. The second section
involves what was ALREADY in our Local's By-Laws and have to be
re-admitted in accordance with the new State By-Laws.

Local dues to be fixed in the amount of .75%
of top base salary (rounded down to the nearest
dollar) and payable in 12 equal monthly
installments.
EXAMPLE: Top base salary in 2006 is
$79,367.00.

be given a Gold Life membership card and pin.
B.
Any Member who serves a complete term on the
Local Executive Board, shall receive their Silver
Life membership card & pin after the expiration of
their first term.
C.
Any Member who serves more than one term on
the Local Executive Board, shall be eligible to
receive their Gold Life Membership card and pin,
upon application to the membership.
D.
Any Member, who serves as President or
Delegate of the Local Association for a full
term, shall receive a Past Presidents/Delegates
ring. If serving more than one term, then after
completion of their final term in Office.
ARTICLE XXX
CONTRACT SETTLEMENT GUIDELINES
1. Proposed Collective Bargaining Agreement (CBA)
final settlement offer’s to be explained to the
Membership at a General meeting.
2. Proposed CBA to be provided to the
membership at the same meeting and 7 days in advance
of the vote, for their review.
3. Proposed CBA to be voted on by ballot.
4. Copy of CBA to be available the day of the
vote.
5. Absentee ballots to be provided to those
members on vacation, military, workers compensation
or bereavement leave only.
6. Those unable to vote in person due to sick
leave will be allowed to vote by phone, provided
that two persons are available. One to record the
vote and a second member to verify that the correct
vote has been cast.
7. All results will be posted in all work areas
immediately.
8. A simple majority is all that is necessary
to ratify a CBA.
9. The President is authorized to sign the CBA
for the Union, provided it is the exact contract
that was voted upon.
10. Any changes to a successfully ratified
CBA, during the life of the agreement, must
follow the same steps listed above (steps 1
through 9).
LOCAL ASSOCIATION A vote of all the members
present at a regular monthly meeting, or special
meeting called for an expenditure(s), shall be taken
on all motions for expenditures of money in excess
of $100.00 .
In the event of the Death of an immediate family
member of a Brother or Sister of this Local
Association, a flower arrangement or donation in
lieu of, shall be sent. The amount spent shall be
inclusive of delivery fees and capped at $50.00.
In the event of the birth of a child to a Brother or
Sister Member, a savings bond or gift shall be given in the
amount of $50.00.

At the
local meeting an assessment of $50.00 per member was passed by a
unanimous vote. Said assessment is due March 1st. Please see you
Unit rep for payment and receipt.

On 02 February an election will take place for the
position of Sergeant at Arms. Election to be held at the Courthouse
from 0800-1700hrs with results immediately available. Bro. Robinson

Raises and Retro will be accomplished on the 23rd of September as
promised.
It will not however, be by a separate check. Because of back pension
payment requirements, they must be made at one time under a single
check.
RETRO
WILL ONLY BE TAXED AT A FLAT 20% (this should have the same net
effect as having a separate check).
Pease also
remember that we have already been paid $1000.00 of Uniform
Maintenance Allowance. Since that will will now be built into our
salary, that amount will be deducted from you Retro.
The County
will have a sample check drawn up so that I may see what it will
look like so it can be explained to you on payday. I will receive
that sometime after my return from Hawaii.

RE: Facts concerning FOP membership and the PBA.
Dear Brother’s & Sister’s,
I’m
writing to you out of concern because it seems that some are being
asked to join the FOP without being told the TRUTH about what it
means. This is not meant to be a commentary on the pros and cons of
each Organization. Each individual will have to decide that for
themselves. Rather I wish to inform you of what you are being asked
to give up.
Firstly, the State PBA By-Laws absolutely prohibit membership in the
FOP. If you join FOP Lodge 195, or any other FOP for that matter,
you forfeit your membership in the PBA. This is not open to question
or interpretation by the Local. It is a mandate by the State
Organization. It is of no consequence whether or not Lodge 195 is
seeking bargaining rights at this time. It is the stated purpose of
the parent Association that does this. They can tell you they are
merely forming an association to perform charitable works. They
could have formed a “good and welfare” committee within Local 314
and performed those same works of charity. They chose not to do
this. But they didn’t form an Elks Lodge, or a K of C, or the like.
They chose instead to charter an FOP Lodge. In the FOP news letter,
President Ferraro states that they intend to attempt to try to
secure bargaining rights. I am not debating the facts of their
choice, just stating what they are.
Secondly, the PBA is the only recognized Union on the property. If
you are not a member of the PBA, you have no Association rights that
come with membership. If you are called into Internal Affairs you
are only entitled to bring a representative of the PBA. The FOP, by
law, cannot appear on your behalf, since they are not recognized by
the Employer.
While on the subject of membership I must explain the following. If
you are a member in good standing of the PBA you are afforded all
rights and privileges. We will stand by you if called in for an
Interview. We will represent you at all hearings and court matters.
You are entitled to use of the PBA’s Legal Protection Plan. You are
entitled to the grievance procedures. You are entitled to a voice at
all meetings and a vote on all maters and in all elections.
Before you dismiss this as inconsequential, consider this:
Officer’s are regularly called in to be interviewed for simply doing
their job. The Officer’s involved in the shooting in August 2003
were only doing their job. People make complaints regularly to
better their position with respect to MV summons and criminal
charges. It is not uncommon for the general public to make “manner
and disposition” complaints because of the way they were talked to
or treated. It is a fallacy to believe that as long as you do your
job, you’ll never be called on the carpet. It happens all of the
time.
If
you resign from the PBA, so as to become a member of the FOP, you
will be required to pay 85% of all dues and assessments of the PBA.
You would not be entitled to representation, but you would be
entitled to a vote on all contractual matters.
If
you do not resign, as is your obligation to, we will remove you from
the PBA. You would not be required to pay any dues or assessments of
the PBA. But, you will not be allowed to vote on any contractual
matters.
Thirdly, if you loose your membership in the PBA, you do not have
the automatic right to return. You would be required to make
application to the Local, at which point a Committee would be
formed. The Committee would make a recommendation on whether or not
to allow you back into the PBA. If allowed back in you would be
required to pay and dues or assessments not paid during your
absence. In addition you would have to satisfy any monetary penalty
imposed by the Judiciary Committee. In other words, if you seek to
return after a two year absence, you would be required to pay two
years of missed dues, any assessments collected during this time,
your fine as imposed by the Judiciary Committee as well as the new
membership fee.
And
lastly, you will have no liaison with any other Police Agencies
within Monmouth County and throughout most of the State. No other
Police Agency in Monmouth County, with the exception of the
Brookdale Community College Police Department, is represented by an
FOP Lodge. In my past seven years as State Delegate we have made
great strides in co-operation with other PBA’s in the County. I
personally know each and every Delegate in the County. We meet
regularly and work together often on matters affecting us all.
Whenever a problem has arisen, it has been handled through the
Conference to everyone’s satisfaction. We have received numerous
off-duty jobs and enjoyed a closer relationship with our Brother’s &
Sister’s because of the PBA.
And
being such a staunch PBA County, an FOP Lodge is not going to be
well received. The other Delegate’s have already been informed of
the chartering of FOP Lodge 195. The cards issued by Lodge 195,
unless possessed by an Officer or their immediate family will not be
honored.
I
hope this has been informative to you as to just exactly what you
risk by joining the FOP. If you should have any questions regarding
this memo, please do not hesitate to contact me to discuss it. I am
available to you both at work and at home and all discussions will
be held in the strictest of confidence.

ARTICLE XV JUDICIARY COMMITTEE:
Section 2 LOCAL ASSOCIATION:
Article F (new Article) Sub Committee of Judiciary, a Grievance
Committee shall be formed.
1.
The President shall appoint 4 members, and along with the
President shall constitute a Committee of 5 (five) members. A full
Committee must meet to discuss these matters. If a Member is unable
to attend then the President shall replace that Member as needed.
2.
After a grievance has reached step three of our Collective
Bargaining Agreement and before it is filed for Arbitration the
Committee shall meet to discuss the grievance.
3.
If contractual time constraints do not allow for the
Committee to meet, then the President shall be authorized to file
for PERC relief pending the Committees decision. If the Committee or
the Membership decides not to prosecute a grievance that has been
filed for PERC relief, then it shall be withdrawn.
4.
The Committee, by a simple majority shall decide whether or
not to prosecute the grievance any further. The President shall only
vote in the event of a tie.
5.
The Committee shall submit their findings and conclusions to
a regular meeting of the Local Association.
6.
The decision of the Committee to forward a grievance to PERC
shall be final.
7.
A Member having a grievance turned down by the Committee
shall have the right to appeal to the general membership. If by a
majority vote of the members present at a regular meeting, the
membership votes to go forward with a grievance, it shall be filed
with PERC.

13 October 2004 By the following vote count (19 yes, 1 opposed, 2
abstaining) the assessment was voted through. Please be advised that
this assessment will occur when we are paid for the third time in
December. The check where this will occur will not have normal Union
dues or Pension deductions. Also, according to the
By-Laws, no absentee votes were allowed. See below excerpt from
Article XVI, Section 4, Paragraph 2 of our Local By-Laws:
2. LOCAL ASSOCIATION This Local shall have the absolute right and
privilege to levy any and all assessments on each member for any and all
purposes that may be required by this Local. No such assessment shall be made
except by 2/3's vote of a quorum therefor at a regular or special meeting called
for that purpose. In addition, no assessment can be levied against
any member of this Local for collective bargaining or majority
representative purposes who is not a member of that bargaining unit.
